Social Media Collaboration Policy

(Effective date: January 1, 2020)

Welcome! Smash N Bash, LLC (“Smash N Bash,” “we,” “us,” or “our”) collaborates with creators whose content aligns with our brand and community. To keep things fair, safe, and compliant with applicable U.S. federal and Texas laws, we follow the policy below.

Important: We do not provide complimentary sessions/products in exchange for a single social post. We consider structured, value-aligned partnerships only.


1) Scope & Who This Applies To

This policy applies to any creator, influencer, affiliate, or media partner (“Creator”) who wishes to promote, review, or feature Smash N Bash experiences, including content posted to Instagram, Facebook, TikTok, X, YouTube, blogs, podcasts, television, or newsletters.


2) Partnership Options

We offer collaboration paths that are transparent and mutually beneficial:

  • Affiliate Program – Creators earn commission via tracked links/codes on qualified purchases.
  • Discounted Trial Session – One-time discounted booking (10%) to experience our venue and create authentic content.
  • Campaign Partnerships – Multi-post packages or paid projects with defined deliverables, usage rights, and timelines.

We do not offer free sessions for one-off posts or filming for television. Requests of that nature will be politely declined.


3) How to Apply

Email info@smashnbash.com with:

  • Links to your channels + media kit, demographics, average views/reach, and engagement rates
  • 3–5 campaign examples and results (if available)
  • Your concept (angles you’d cover, posting plan, timing)

We review audience fit, historical performance, and brand alignment. If approved, we’ll issue a short agreement with deliverables, deadlines, and compensation terms.


4) Required Disclosures & Advertising Compliance (FTC)

Creators must follow the FTC Endorsement Guides. If there’s any material connection (discount, affiliate link, payment, free or reduced services, etc.), you must:

  • Make the relationship clear and hard to miss at the beginning of the caption or within the first seconds of audio/video (e.g., “Ad,” “Sponsored,” “Paid partnership with Smash N Bash,” “Smash N Bash Partner”).
  • Use plain words like “Ad” or “Sponsored.” Avoid vague tags (e.g., “collab,” “sp,” “spon,” or just “thanks”).
  • For video/Stories/Reels: a verbal disclosure and on-screen text large enough to read on mobile.
  • Keep disclosures on every platform/post format and don’t bury them among hashtags or links.

5) Truthful, Substantiated Content

  • Your content must be honest and not misleading.
  • Do not make claims we couldn’t legally make ourselves (e.g., safety or health claims) and don’t exaggerate outcomes.
  • Any objective claim must be truthful and supportable. (FTC advertising substantiation.) Federal Trade Commission+1

6) Safety, House Rules & On-Site Filming

While filming on site you must follow all venue rules, including age and shoe requirements, waivers, and staff instructions. Safety visuals (closed-toe shoes, protective gear) should be shown accurately.

We may limit filming to certain rooms/times. Any behind-the-scenes content must not depict unsafe behavior.


7) Content Standards & Approvals

  • Tone: energetic, positive, and accurate to the Smash N Bash experience.
  • Prohibited: profanity directed at staff, hate speech, dangerous acts, depictions of unsafe conduct, or content that violates platform rules or laws.
  • Pre-flight check (if required by the campaign): Send drafts to your Smash N Bash contact at least 3 business days before posting for brand/safety review. We do not edit your opinions, but may request corrections to inaccurate or non-compliant statements.

8) Rights & Usage

Unless otherwise agreed in writing:

  • Creator owns their original content; Creator grants Smash N Bash a non-exclusive, worldwide, royalty-free license to repost and use in our organic social, website, and in-venue displays with attribution (handle/tag) for 48 months.
  • Paid ads/boosting, whitelisting, print, or OOH usage requires a separate written addendum.
  • Creator must have rights to all music, footage, and talent shown and secure any necessary permissions/releases.

9) Promotions, Contests & Giveaways (Texas + Federal)

If your collaboration involves a giveaway/sweepstakes:

  • No purchase necessary; include official rules, eligibility (e.g., must be 18+), start/end dates, prize description/ARV, winner selection method, odds, and how winners are contacted.
  • Comply with platform rules and Texas and federal requirements; avoid unlawful lotteries (prize + chance + consideration). Remove consideration or provide free alternative entry.

We must pre-approve any promotion that uses our name, trademarks, venue, or offers our services as prizes.


10) Email & SMS Mentions (If You Promote Our Links or Capture Data)

If a campaign includes email or text outreach to your audience:

  • Email: comply with CAN-SPAM (clear identification as ads, valid postal address, easy opt-out, honor opt-outs promptly). Federal Trade CommissionFederal Communications Commission
  • SMS/Calls: comply with TCPA—obtain appropriate consent prior to sending marketing texts/calls; include opt-out instructions; honor Do-Not-Call rules. (Penalties are significant; we require proof of consent flows.) Reuters

Creators are responsible for their own compliance systems and records.


11) Privacy & Data

If you collect personal information during a campaign (e.g., entries, emails, phone numbers), you must:

  • Use it only for the stated purpose; secure it; and delete it upon request or campaign close unless you have independent, lawful consent.
  • Provide your own accessible privacy notice and honor all opt-out/rights requests.
  • Share only aggregated, non-personal metrics with Smash N Bash unless otherwise agreed and lawfully consented.

12) Metrics & Reporting

Within 7 days after the final deliverable, send post links and performance metrics (impressions, reach, views, engagement, swipe-ups/click-through, redemptions, tracked sales if affiliate). We reserve the right to audit campaign delivery.


13) Payment & Taxes

Compensation (if any) is detailed in the individual agreement. Invoices are due Net 30 after satisfactory delivery. Creators are independent contractors and responsible for their own taxes and expenses.


14) Brand Protection, Takedowns & Termination

We may request edits or removal of posts that are unsafe, misleading, infringe rights, or violate this policy or the campaign agreement. We may terminate a collaboration immediately for non-compliance, harassment, or reputational risk.


15) No Endorsement by Default

Featuring Creator content or engaging with Creator posts does not equal our endorsement of any unrelated products, services, advice, or claims made by the Creator.


16) Texas & Federal Compliance Reminder

Creators agree to comply with:

  • FTC Endorsement Guides and truth-in-advertising standards (clear, prominent sponsorship disclosures; honest opinions; no deceptive or unsubstantiated claims).
  • Texas Deceptive Trade Practices Act principles (no false, misleading, or deceptive practices).
  • Applicable sweepstakes/contest rules if running promotions.
  • CAN-SPAM/TCPA if using email/SMS marketing.

17) How We Decline Freebie-for-Post Requests

“Thanks for your interest in Smash N Bash! At this time, we’re not offering complimentary sessions in exchange for a influencer post(s). We do offer structured options like our affiliate program, discounted trial sessions, or multi-post campaigns. If you’d like details, please email info@smashnbash.com.”

19) Boilerplate & Incorporation by Reference

This policy works alongside the Cancellation/Reschedule, Gift Card/E-Voucher, Privacy, Age, Shoe, and other posted policies on our website. In case of conflict, a signed campaign agreement controls for that campaign; otherwise, site policies govern. Smash N Bash, LLC,



Television and Media Production

(Effective date: January 1, 2020)

Lighting

Our lighting is not commercial grade lighting for most television & film recordings. If you need additional lighting, you will need to account for lighting set-up time and removal in your package.

Sound

Our walls are not insulated and sound echoes. We understand that filming will require additional sound technicians. We do not provide sound equipment.

Production Crews

We understand the need for production crews to have access to our facility to prepare for filming and including set-up and removal of equipment. We recommend that the large scale your production you adjust accordingly to allow ample time so that your needs are met. All production crew will be required to sign our waivers and release to work in any of our rooms.

It is understood that film crews may be necessary to be in a room during a “smash session.” We do not charge for the film crew in the room unless the participate in the smash session. If you have elected the hourly rate for production time, then there is an additional fee that is limited to $50 per person who was not scheduled to smash items.

The number of crew members is limited to a maximum of one in the room during filming.

Production Equipment

You understand that you are solely responsible and will indemnify Smash N Bash LLC of all liability for lost, damaged, or broken production equipment. Your production equipment is your responsibility to maintain, manage, and account for. You understand that you will not be given any access to our equipment for production purposes.

Facility Use

We agree to allow you use of our facility for a set timeframe per our contract with limitations. You, the production crew, and media personnel will have access to the public areas of our facility only. You agree and understand that no access will be given to areas that would infringe on others, our security, our staff, or inventory, etc. You also understand due to space limitations your production company will only be given access to one bathroom that is not ADA accessible. The building was built prior to ADA compliance laws, and our facility is “grandfathered in.”

You agree to abide by all safety rules, regulations and standards set by Smash N Bash LLC while in our facility. Any intentional attempts to subvert, alter, or ignore such rules and regulations will result in ejection from the facility, without compensation of lost time, moneys, or incomplete filming.

Filming Cost

Our base rate for television and film is at an hourly rate of $450.00, with a minimum of 3 hours required for contract to be offered.

What is included:

  • One (1) hour to set up production equipment, test lighting and sound, fill out waiver and release forms.
  • One (1) hour Twenty minutes of filming allowed.
  • One (1) hour of post-production equipment removal.
  • We will provide safety gear, breakables, smash tools, and water for the room participants
  • Some breakable items are included (our standard crates for up to 12 people) larger items may be purchased at an additional charge.
  • Copy of our closed-circuit feed for your use.
  • Business Lifetime mention and link on our website to promote your content.
